Document a Preliminary Trademark Clearance Search

A reproducible search log and conflict-candidate list for a trademark attorney, not a registrability or infringement opinion.

The process

Work it in this order.

  1. Record the proposed word or design mark, owner, intended goods or services, territory, and target filing timeline.
  2. Identify relevant goods and services descriptions, classes, design elements, and likely consumer context.
  3. Search the USPTO system for exact wording, expanded terms, alternative spellings and pronunciations, and relevant designs or coordinated classes.
  4. Search the internet and other user-approved registries for similar common-law or international uses related to the goods or services.
  5. Capture search strings, filters, dates, result identifiers, status, owner, goods or services, and source links.
  6. Organize potentially similar marks by factual similarity while avoiding a legal conclusion about likelihood of confusion.
  7. Deliver the search log, candidate table, limitations, and unanswered questions to a qualified trademark attorney.

Bring this

Inputs the cat will ask for.

  • Proposed mark or design
  • Goods and services
  • Target territories
  • Known variants or competitors

Router + one playbook

Route first. Choose one.

Cat Paw loads one playbook per task rather than merging several. Start with this router; the remaining paths are workflow-specific candidates it can inspect.

  • Router: skill-packs
  • skills/engineering/mattpocock/research/SKILL.md
  • skills/content/content-creator/SKILL.md

Guardrails

The boundaries travel with the prompt.

  • State prominently that a search cannot guarantee availability, registrability, or freedom from infringement.
  • Do not file an application, contact rights holders, or provide a likelihood-of-confusion opinion.
  • Have a qualified trademark attorney interpret results and advise on filing strategy.

Done means

A checkable finish.

The reproducible search log covers exact, expanded, phonetic or spelling, design when applicable, and common-law searches, and counsel receives all candidate records and limitations.
